PERSONAL RESPONSIBILITY

By purchasing firearms and accessories from Tigard Pawn 4 More, you will also understand and agree to the following:

When handled improperly, firearms are dangerous and can and will cause serious personal harm or death. You will follow all of the manufacturers safety instructions and precautions.

Age does matter, you must be at least 18 to purchase anything from our site, including a long gun (rifle or shotgun) and you must be at least 21 to purchase a hand gun.

You are responsible for checking your local laws before purchasing or using an item purchased from Tigard Pawn 4 More

You assume all responsibility for knowing the item will be legal to own and conform to your local laws and restrictions

You are responsible for complying with your local firearms laws

You MUST provide current valid contact information (phone # & e-mail address) when placing an order with us.

Tigard Pawn 4 More will sell firearms and ship to UNITED STATES RESIDENTS & REGISTERED FFL ADDRESSES ONLY (50 U.S. States) WE DO NOT EXPORT, WE WILL NOT ASSIST IN THE EXPORT OF FIREARMS AND/OR AMMUNITION OR OTHER RESTRICTED COMMODITIES TO FOREIGN COUNTRIES.

When purchasing a firearm or related accessory from Tigard Pawn 4 More, you declare and certify that:

(a) You are the actual transferee / buyer of the firearm and you are not purchasing for another entity or person

(b) You are at least eighteen (18) years of age if purchasing long guns (rifles & shotguns) or related accessories

(c)You are at least twenty one (21) years of age if purchasing hand guns or ATF defined “OTHER” firearm (including, but not limited to: stripped receivers or frames and/or related accessories)

• You are not under indictment or information in any court for a felony, or any other crime that a judge could imprison you for more than one year

(e) You are not a fugitive from justice

(f) You have never been convicted in any court of a felony, or any other crime, for which a judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation

(g) You are not an unlawful user of, or addicted to marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.

(h) You have not been adjudicated mentally defective (which includes a determination by a court, board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs) OR have not been committed to a mental institution

• You have not been discharged from the armed forces under dishonorable conditions

(j) You are not subject to a court order restraining you from harassing, stalking or threatening your child or an intimate partner or child of such partner

(k)You have not been convicted in any court of a misdemeanor crime of domestic violence

• You have never renounced your U.S. Citizenship

(m) You are not an alien illegally in the United States

(n) You are not currently on Federal NCIS or state agency “delay” or “denied” status regarding your most recent last attempt to purchase a firearm. Firearm and / or ammunition or ammunition component sales or transfers are prohibited during these conditions.

You understand that handling, cleaning or shooting firearms and / or ammunition can cause your personal exposure to lead and you hold TigardPawn4More.com harmless and you assume all responsibility for any lead exposure.

ELECTRONIC COMMUNICATION

When you visit TigardPawn4More.com and / or send us e-mails, you are communicating with us electronically. By doing so, you consent to receiving electronic communications from us. We will communicate with you by e-mail or by posting notices on the web site. You agree that all agreements, notices, disclosures and other communications that Tigard Pawn 4 More provides to you electronically satisfies any legal requirement that such communications be in writing.

LICENSE AND SITE ACCESS

TigardPawn4More.com grants you a limited license to access and make personal use of this site and not to download or modify it, or any portion thereof, except with express written consent of TigardPawn4More.com. It is not OK to collect and use any product listings, their descriptions, photos or prices for commercial benefit. This site or any portion of this site may not be reproduced, copied or sold or otherwise exploited for any commercial benefit or purpose without express written consent by TigardPawn4More.com. You are granted a limited, revocable and nonexclusive right to create a hyperlink to the home page of TigardPawn4More.com as long as the link is not used to and does not portray TigardPawn4More.com and affiliates or products or services in a false or misleading or derogatory or offensive manner.

ORDER CANCELLATION / INABILITY TO PICK UP FIREARM

All orders returned to TigardPawn4More.com due to failure to pass NICS background check are subject to a 50% restocking fee plus freight and insurance costs. The moral here is, PLEASE BE SURE THAT YOU KNOW YOU WILL PASS BEFORE YOU ORDER.

If you change your mind because you are “delayed” by NICS and want to return the items purchased, you will be charged a 50% re-stocking fee and you will be responsible for all of the freight costs associated with your order. Sometimes, law enforcement will run into questions about a person’s background that they need to verify before allowing a firearm to be picked up by the purchaser, and that can take some time for them to resolve. This situation is beyond our control and we accept no responsibility for this situation.

Cancelled orders that are already in transit are subject to a 30% restocking fee plus freight and insurance costs.

If the firearm or item that you have ordered arrives damaged or broken (unless the condition was agreed to prior to purchase) , DO NOT accept the item from your FFL (do not do the background check) and CALL US immediately (503) 624-7800 TigardPawn4More.com will issue a call tag and initiate an insurance claim for the order. Once TigardPawn4More.com receives the damaged shipment in it’s entirety, we will issue a full refund for the purchase. Communication will be the key to clearing things up in a professional manner.

WE ARE SELLING USED AND / OR PRE-OWNED MERCHANDISE

For the most part TigardPawn4More.com is selling items that are in used condition or items that are pre-owned in like new condition. We do have, from time to time factory new items for sale and we will disclose the condition of the item listed for sale as accurately as we possibly can and we take lots of pictures for you to view, prior to purchasing. All pictures provided will be of the actual item listed for sale, unless otherwise noted. If you have condition questions that can not be resolved by viewing the pictures provided, then please feel free to give us a call (503) 624-7800 and we will be glad to assist you with your concerns before you purchase the item (s) If there are no condition questions raised prior to purchasing any item from TigardPawn4More.com, it will be considered as acceptance of condition as posted on the web site.

ALL ITEMS SOLD ARE IN “AS-IS,WHERE-IS,AS-AVAILABLE” CONDITION

No warranty is expressed or implied by TigardPawn4More.com on the items sold as to the suitability for use or life expectancy. Some manufacturers MAY have warranties for their products beyond their original sale and weather or not the original manufacturers will or will not honor their warranty is beyond the control of TigardPawn4More.com.

HAVE YOUR FIREARM INSPECTED BY A LICENSED GUNSMITH PRIOR TO SHOOTING.

Sometimes, firearms can have hidden defects that cannot be detected without the trained eye of a professional gunsmith, please have your firearm inspected prior to shooting for your safety. TigardPawn4More.com will allow for a 3 day inspection period to detect such conditions. If such conditions exist, TigardPawn4More.com must be notified within the three (3) day inspection period, prior to picking up from the gunsmith (503) 624-7800. TigardPawn4More.com will work with the gunsmith to resolve the issue or hidden defect at hand. The resolution may include, but is not limited to: repair of the firearm or return of the firearm and full refund. TigardPawn4More.com reserves the right to have the firearm inspected by their own gunsmith prior to refunding any money.

ITEM AVAILABILITY / QUANTITY IN STOCK, READY FOR SALE

Items listed for sale on TigardPawn4More.com are listed on an item by item basis, that means that each listing is for a single specific item for sale and there is only one (1) of that particular item available. In the event that there are multiple orders for an item, the FIRST FULLY FUNDED order will receive priority. Refunds will be issued for any secondary payments received for an item that has already been sold.

The items that we have listed online are also available at our physical location in our showroom for purchase. The items that are listed online for sale are specially selected and are not our entire inventory that we have for sale, please check our “USED GUNS” page at www.tigardpawn4more.com to view our entire inventory for sale.

PAYMENT METHODS ACCEPTED

Our site is equipped to accept Visa, MasterCard, American Express and Discover, and debit cards with the Visa logo.

We can and will accept payment via the mail WITH special conditions:

• payments made via mail MUST be in the form of a UNITED STATES POSTAL MONEY ORDER or ANY KIND OF CHECK (personal, cashiers, business) FROM WELLS FARGO BANK, made out to Tim Barnes

• any other kind of payment will be rejected and returned to sender

(3)you will run the risk of having someone pay in full via online before your payment arrives and loose the ability to secure the item you want. In that event, we will just return your payment to you.

• An online deposit (non-refundable) of 25% of the purchase price will hold the item for you for 5 business days to give you time to get the rest of the payment to us via U.S. mail (we would suggest that you use 2 day priority mail) if that would somehow work better for you.
